Privacy Policy

This Privacy Policy explains how AM Retail Group, Inc. and its parent, subsidiary, and affiliate entities (collectively, “AMRG,” “we,” “us,” or “our”) collects and uses information:

·       when you access or use our website at www.donnakaran.com, or any other website, application, or online service that we operate which includes a link to this Privacy Policy (collectively, the “Sites”);

·       through purchases in-store;

·       in connection with our reward program; or

·       when you contact us.

By visiting and using the Sites, or using any of the services described above, you agree to our collection, use and disclosure of your information as described in this Privacy Policy. We reserve the right to modify this Privacy Policy at any time, in which case we will notify you of any material changes by uploading the updated Privacy Policy to the Sites and changing the Effective Date. You should read the Privacy Policy periodically to address any changes. Your continued use of the Sites and our services following any changes to the Privacy Policy will be considered your consent to such changes.

 

1.    WHAT TYPES OF INFORMATION DO WE COLLECT?

INFORMATION YOU ACTIVELY PROVIDE. When you use the Sites, buy our products, register for any online account or reward program, sign up for marketing communications from us, participate in our sweepstakes or surveys, submit information or post on the Sites, contact our customer service, interact with us on social media, or otherwise interact with our services or Sites, we may collect different types of information from you. The information collected may include, without limitation, your name, e-mail address, billing address, shipping address, phone number, payment card information, order information, products you’re interested in, communications with us, birthday, login name and password, gender, and location.


PASSIVE DATA COLLECTION. We may use cookies and similar technologies such as pixel tags and web beacons on the Sites or in the emails we send to you for a number of purposes. The personal information we collect in this manner includes your Internet Protocol (IP) address, Internet service provider, operating system, type of web browser, mobile or other device identification number, pages and products you view, page interaction information (e.g., scrolling, clicks, and mouseovers), your interactions with marketing materials (e.g., whether and when you opened an email from us, whether you clicked a link in the email, or forwarded the email), the duration of time spent on the Sites, and website you came from or what website you visit when you leave the Sites.

You may opt-out from cookies at any time by changing your browser settings. While you are free to decline cookies, doing so may prevent you from taking full advantage of all features of our Site. 2.    HOW DO WE USE YOUR INFORMATION?


TO PROVIDE COMPLETE SERVICES. We use your information to respond to your requests, to process and deliver purchases, to process returns, and to offer you products, services and features through the Sites. We may use your information to respond to your customer feedback.


FOR MARKETING AND ADVERTISING PURPOSES. To provide you with marketing communications, and updates on special offers, campaigns, products and services that we believe you may be interested in. We use your information to provide targeted advertising to you, so that the ads you see are tailored to your interests. We may tailor the content of those communications based on our understanding of your preferences.

TO IMPROVE OUR PRODUCTS AND SERVICES. We may use your information to make the Sites and our products and services better. We may perform research or ask you to complete surveys to understand your preferences about our products and customer experience. We might use your information to further customize and improve your experience with us. We may combine information we get from you with information about you we get from third parties.

FOR THE PERFORMANCE OF CONTRACTS. To perform our obligations and exercise or enforce our rights under our Terms of Use or any other agreement.

PROTECTION OF LEGAL INTERESTS. To comply with and enforce applicable legal requirements and to protect our legal interests, such as in the event of establishment, exercise or defense of any legal claims.

SECURITY. We may use your information to protect our company and our customers. We also use information to protect the Sites. This may include using your information for fraud protection or credit risk reduction purposes.

TO COMMUNICATE WITH YOU. For example, we will communicate with you about your account or respond to any queries you have when you contact customer service. We may contact you about your feedback. We might also contact you about this Privacy Policy or our Terms of Use.

OTHER USES. We may use information for other reasons we may describe to you, or as otherwise permitted by law.

 

3.    HOW WE SHARE YOUR INFORMATION.


We may share your information with third parties in the following ways:

G-III FAMILY. We are part of the G-III Apparel Group, Ltd. (“G-III”) corporate family. We refer to G-III and its affiliates within this Privacy Policy as the “G-III Family.” A list of current members of the G-III Family is located at www.g-iii.com. We may transfer information to other members of the G-III Family. We will share this information for our business purposes, including for order fulfillment, and to otherwise engage in the activities described in this Privacy Policy. For example, if you sign up for marketing emails from one of our brands, we may use your information to create and send you similar marketing materials for another brand’s products that may interest you.

BUSINESS TRANSFER. We may transfer your information to third parties in connection with a reorganization, restructuring, merger, acquisition or transfer of assets by us or any one of our affiliates.

SERVICES AND PROMOTIONS. We may share information with third parties who perform services on our behalf and help operate our Sites. The third-party partners we use may include: (i) online payment and fraud prevention service providers; (ii) delivery and logistics service providers; (iii) customer care services; (iv) infrastructure and IT service providers; (v) marketing, advertising and communication agencies; (vi) providers of web testing and analytics services; or (viii) external auditors and advisers.

AGGREGATE STATISTICS. We may disclose information collected from multiple individuals in the form of aggregate data that does not describe or identify any individual user. This may include things like age and gender. It may also include product purchase information, search terms and pages visited. We may share such information with third parties to show interest in, and use of, our Sites.

FOR MARKETING PURPOSES. We may share your information with third parties who co-sponsor a promotion or whose products and services we believe you may be interested in. These third parties may send you information about events and products by mail or email. These third parties may also share your information with others. These third parties may use the information for their own marketing purposes or the marketing purposes of others. This may include the delivery of interest-based advertising.

LINKS TO OTHER WEBSITES. We may have links to other websites or apps on the Sites or have other third-party services on our platforms that are not owned or operated by us. If you click on a third-party link, you will be taken to a website or platform we do not control. This policy does not apply to the privacy practices of that website or platform, and we are not responsible for the practices of these third parties.


TO COMPLY WITH THE LAW OR PROTECT OURSELVES. We may be required to disclose or share your personal information to comply with a legal or regulatory obligation. For example, we may be required to disclose personal information to regulators, government agencies or to judicial or administrative authorities. We may also disclose information to third parties where disclosure is both legally permissible and necessary: (i) to protect or defend our rights; (ii) for law enforcement purposes; (iii) to investigate potential fraud; or (iv) to enforce our Privacy Policy or Terms of Use.

NOTE FOR INTERNATIONAL USERS: WE STORE INFORMATION BOTH IN AND OUTSIDE OF THE UNITED STATES. If you live outside of the United States, you understand and agree that we may transfer your information to the United States. The Sites are subject to U.S. laws, which may not afford the same level of protection as those in your country.

 

4.    HOW DO WE SECURE YOUR INFORMATION?

 

We keep personal information for as long as it is necessary or relevant for the practices described in this Privacy Policy, or as otherwise required by law. As described in Section 5 of this Privacy Policy, you may request we delete your information.

We have implemented measures in an effort to safeguard information in our custody, but we can’t guarantee that any use of the Internet is completely safe. We encourage you to use caution when using the Internet. You are responsible for maintaining the confidentiality of your account credentials, and we strongly recommend you do not disclose your account username and password to anyone. We may contact you if your information is compromised. If we have your e-mail address, we may notify you by e-mail.

 

5.    YOU HAVE CERTAIN CHOICES ABOUT HOW WE USE YOUR INFORMATION


RECEIVING CERTAIN TYPES OF MARKETING CORRESPONDENCE. You can opt out of receiving our marketing emails. To stop receiving our marketing emails, follow the “unsubscribe” instructions in any marketing email you receive from us or log in to your account and change your settings. Even if you opt out of getting marketing messages, we will still send you transactional messages, including information about your order(s) or responses to your questions. MOBILE. Your mobile device may give you the ability to opt out of the use of information regarding the apps that you use for targeted advertising. You may opt out of the collection of location information by specific apps or from your entire device at any time by changing your preferences on your mobile device. Note that when location services have not been enabled in your apps, we may infer data about your location based on your IP address. COOKIES, TRACKING, AND INTERNET-BASED / TARGETED ADVERTISING. If you would like to stop or restrict the placement of cookies or flush any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. DO NOT TRACK.  Some browsers have a “do not track” (also known as DNT) feature that lets you tell websites that you do not want to have your online activities tracked. Please note that, unless required by law, we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

UPDATE, MODIFY, OR CORRRECT YOUR INFORMATION. You may correct or update your information at any time. You can do this by logging in to “My Account” on the Sites. You can also send an email to service@donnakaran.com. If you ask, we will send you a copy of any information we have on file in your user account. Before we are able to provide or change any information, we may ask that you verify your identity. We may also ask for more details to help us respond to your request.

 

6.    CHILDREN


The Sites are not meant for children under the age of sixteen. We do not knowingly collect personally identifiable information from children under the age of thirteen without permission from a parent or guardian. 7.    YOUR CALIFORNIA PRIVACY RIGHTS

 

The California Consumer Privacy Act (the “CCPA”) and California Privacy Rights Act (the “CPRA,” and, collectively with CCPA, the “California Consumer Privacy Laws”), provides California residents with certain rights regarding their personal information that is collected by businesses, including the right to request information regarding the collection, use, sale, and disclosure of their personal information, the right to request the deletion of their personal information, and the right to opt-out of the sale of their personal information. AMRG has decided to allow all of its customers, regardless of where they reside, to make the same requests. This section provides information about the California Consumer Privacy Laws and about the type of personal information AMRG collects and shares with other companies. It also explains how you can make requests to AMRG regarding your personal information. Any terms defined in the CCPA (Cal. Civ Code § 1798.140) have the same meaning when used in this section.

This California Privacy Rights section describes your rights under the California Consumer Privacy Laws, explains how you may exercise your rights, and provides an overview on the types of personal information we collect.

(a)   Your Rights and Choices

 

(i)             Right to Know What Personal Information is Collected About You and How It Is Used

You have the right to know what categories and specific pieces of personal information we collect about you, the sources from which we collect personal information, our business or commercial purpose for the collection, use, and sharing of your personal information, and any categories of third parties to whom we sell or with whom we share your personal information.  You have the right to request that AMRG disclose certain information to you about our collection and use of your personal information over the past 12 months. This may be referred to as a “Right to Know Request”) Once we receive and confirm your verifiable consumer request (see Exercising Right to Know, Right to Delete, Right to Data Portability, and Right to Correct Requests), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you.
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • The categories of personal information that we have sold about you, and the categories of third parties to whom the personal information was sold.
    • The categories of personal information we have disclosed about you for a business purpose.

 

(ii)            Right to Delete Personal Information

You have the right to request that AMRG delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Right to Know, Right to Delete, Right to Data Portability, and Right to Correct Requests) we will delete, and direct our service providers to delete, your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us, or our service providers, to:

  1. Complete the transaction for which we collected the personal information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities
  3. Debug to identify and repair errors that impair existing intended functionality.
  4. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
  5. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  6. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

(iii)          Right to Data Portability

You have the right to request that AMRG provide you with a copy of personal information we have collected and maintained about you in the past 12 months. California Consumer Privacy Laws allow you to request your information from us up to twice during a twelve (12) month period.  We will provide our response in a readily usable format, which is usually electronic.

(iv)          Right to Correct

You have the right to request that AMRG correct any personal information we retain about you.

(v)            Right Opt-Out of the Selling or Sharing of Personal Information

At the time this Privacy Policy was last updated, we (1) DO SELL personal information; and (2) we DO SHARE personal information for the purpose of cross-context behavioral advertising. You have the right to opt out of the sale or sharing of your personal information, along with the right to opt in to the sale of such information. If we sell or share any of your personal information, you may, at any time, tell us not to sell or share your personal information (see Exercising the Right to Opt-Out of the Selling or Sharing of Personal Information).

(b)  Exercising Right to Know, Right to Delete, Right to Data Portability, and Right to Correct Requests

To exercise your Right to Know, Right to Data Portability, Right to Correct, or Right to Delete as described above, please submit a verifiable consumer request to us by either:

Only you, or your authorized agent, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor

child.

 

You may only make a verifiable consumer request for a Right to Know twice within a 12-month period. The verifiable consumer request must:

·       Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and

·       Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Making a verifiable consumer request does not require you to create an account with us.

To use an authorized agent to make a verifiable consumer request, you must provide the authorized agent written authorization to do so. You may also be required to verify your own identity directly with AMRG. AMRG may deny a request from an authorized agent that does not submit proof that they have been authorized to act on your behalf. Such requirements, however, will not apply where you have provided the authorized agent with power of attorney pursuant to Cal. Probate Code §§ 4000 to 4465.

Upon receiving a Request to Know or a Request to Delete, we will confirm receipt within 10 days and provide information about how we will process the request, how we will verify your identity, and when you should expect a response (except in cases in which we have already granted or denied the request). We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. 

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For Right to Know requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

(c)   Exercising the Right to Opt-Out of the Selling or Sharing of Personal Information

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by visiting Do Not Sell or Share My Personal Information

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by signing up for emails.

 You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

If we have a good faith, reasonable, and documented belief that a request to opt-out is fraudulent, we may deny the request.

You may use an authorized agent to submit a request to opt-out on your behalf. To use an authorized agent to submit an opt-out request, you must provide the authorized agent with written authorization. We may deny a request from an authorized agent that does not submit proof they have been authorized by you to act on your behalf.

(d)  Non-Discrimination

We will not discriminate against you for exercising any of your California rights. Unless permitted by California law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

However, we may charge you a different price or rate, or provide you a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by your information. We may offer you financial incentives, including payments as compensation, for the collection of personal information, the sale of personal information, or the deletion of personal information. We may also offer a different price, rate, level, or quality of goods or services to you if that price or difference is directly related to the value provided to us by your data. We will notify you of any financial incentives. We will only enter you into a financial incentive program if you give us prior opt-in consent that clearly describes the material terms of the financial incentive program, which you may revoke at any time. We will not use financial incentive practices that are unjust, unreasonable, coercive, or usurious in nature.

(h)  Shine the Light Law

Under California Civil Code Section 1798.83 (“Shine the Light”), if you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please send us an email at service@donnakaran.com. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

8.    OTHER STATE PRIVACY RIGHTS

 

(a)   Your Nevada Privacy Rights

Nevada law permits our users who are Nevada consumers to request that their personal data not be sold (as defined under applicable Nevada law), even if their personal data is not currently being sold. Requests may be submitted by visiting Do Not Sell or Share My Personal Information  or contacting service@donnakaran.com and are free of charge.

(b)  Your Texas Privacy Rights

The Texas Data Privacy and Security Act (TDPSA) provides Texas residents with the rights listed below, subject to applicable law. The categories of personal information we process, our purposes for processing your personal data, the categories of personal data that we share with third parties and the categories of third parties with whom we share it are detailed above in this Privacy Policy.

Certain rights that you may have concerning your personal data are set forth in this Privacy Policy. The TDPSA provides you with the following additional rights:

  • Right to know. You have the right to know and see what personal data we have collected about you.
  • Right to data portability. You have the right to obtain a copy of your personal data that you previously provided to us in a portable and, when feasible, readily usable format, where the processing is carried out by automated means.
  • Right to delete. You have the right to request that we delete the personal data we have collected about you.
  • Right to opt out of selling or sharing. You have the right to opt out of the sale of your personal data and/or the processing of your personal data for purposes of (i) targeted advertising or (ii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. As of the latest date of the Privacy Policy:
    • We DO process personal information for the purposes of targeted advertising
    • We DO sell your personal information in exchange for monetary consideration
    • We DO NOT engage in profiling decision based on your personal information that produce legal or similarly significant effects concerning you.

  • Right to correct. You have the right to request that we correct inaccurate personal data.
  • Right to nondiscrimination. You have the right not to receive discriminatory treatment by us for the exercise of your TDPSA privacy rights. Unless permitted by the TDPSA, we will not:
    • Deny you goods or services.
    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
    • Provide you a different level or quality of goods or services.
    • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

(c)   Verification of Your Identity

After submitting a request, we will take steps to verify your identity in order for us to properly respond and/or confirm that it is not a fraudulent request. In order to verify your identity, we will request, at a minimum, that you provide your name, email address, phone number, address, and relationship to us, so that we can seek to match this information with the information existing in our systems. When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify using reasonably commercial efforts that the consumer submitting the request is the same individual about whom we have collected personal information, then we are not required to comply with the request; we may contact you for more information reasonably necessary to authenticate the request, but ultimately we may not be able to meet your request.

Only you may make a verifiable request related to your personal information. If you are making a request as the parent or legal guardian of a known child regarding the processing of that child’s personal information, we may ask you to submit reliable proof of your identity.

(d)  Our Response Time to Your Request

We will make every effort to respond to your request within forty-five (45) days from when you contacted us. If you have a complex request, the TDPSA allows us up to ninety (90) days to respond. We will still contact you within forty-five (45) days from when you contacted us to let you know we need more time to respond and the reason for the extension.

(e)   Your Right to Appeal

If we decline to take action regarding a request that you have submitted, we will inform you of our reason for declining to take action and provide instructions for how to appeal the decision. In the event that we do not respond to a request that you make pursuant to one of the privacy rights set forth in this Texas Privacy Rights section, you have the right to appeal our refusal to take action within a reasonable period of time after you receive our decision. Within 60 days of our receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If the appeal is denied, we will also provide you with an online mechanism, if available, or other method through which you may contact the Attorney General to submit a complaint.
